1. ACCEPTANCE OF THESE TERMS

By using FaithFi sites and mobile applications (together, “FaithFi”), whether as a guest or a registered user, you accept and agree to these Terms. Please read these Terms carefully before you start to use FaithFi, as well as the FaithFi Privacy Policy. If you do not agree to these Terms or the FaithFi Privacy Policy you must not access or use FaithFi.


2. CHANGES TO THE TERMS 

FaithFi is licensed to You (“end-user”) by FaithFi: Faith & Finance LLC, a Georgia Limited Liability Company (“FaithFi: Faith & Finance,” “we” or “us”). We reserve the right to modify the Terms of licensing.


We may revise and update these Terms from time to time at our sole discretion. Any changes are effective when we post them. Your continued use of FaithFi following the posting of revised Terms means that you accept and agree to the changes.


3. CHANGES TO FAITHFI

While we hope to continue to offer FaithFi and all of its features, we reserve the right to change or cease offering FaithFi or any part, portion or functionality of FaithFi without notice. We will not be liable if for any reason all or any part of FaithFi is unavailable at any time.


4. INFORMATION ABOUT YOU AND YOUR ACCESS OF FAITHFI

All information we collect on or through FaithFi is subject to our Privacy Policy. By using FaithFi, you consent to all actions taken by us in compliance with the Privacy Policy.


5. ACCOUNT SECURITY

FaithFi allows users to create an account (“Users”) which requires providing certain information to FaithFi Media. If you choose, or are provided with, a username, password, or similar information as part of our access and security procedures, you agree to treat such information as confidential, and agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security. 


We have the right to disable any username, password, or other identifier, whether chosen by you or provided by us, at any time if, in our opinion, you have violated any provision of these Terms.


6. COPYRIGHT, TRADEMARKS, AND LINKING

FaithFi and its contents, features, and functionality (including but not limited to all information, software, algorithms, text, displays, images, video, and audio, and the design, selection, and arrangement of the same), are owned by FaithFi Media, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.


FaithFi contains links to other websites and content. We neither control nor endorse such other sites or content. You are solely responsible and liable for your use of third party sites.


7. PERMITTED AND UNPERMITTED USE

You may use FaithFi in accordance with these Terms for your personal and non-commercial use. All rights not expressly granted to you are reserved by FaithFi Media. You agree you are not permitted and will not use FaithFi as follows:


  • in any way that violates any federal, state, local, or international law or regulation;
  • to impersonate or attempt to impersonate any company or person, including FaithFi Media or another FaithFi user;
  • to engage in any other conduct which, as determined by us, may harm FaithFi Media or users of FaithFi or expose them to liability;
  • in any manner that could disable, overburden, damage, or impair FaithFi or interfere with any other person’s use of FaithFi;
  • use any robot, spider, or other automatic device, process, or means to access FaithFi for any purpose, including monitoring or copying any of the material on FaithFi;
  • to introduce any viruses, Trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful;
  • to attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of FaithFi or any server, computer, or database connected to FaithFi;
  • to attack FaithFi via a denial-of-service attack or a distributed denial-of-service attack; and
  • otherwise attempt to interfere with the proper working of FaithFi.


You also agree that you will not send, knowingly receive, upload, download, use, or re-use any material which:


  • contains any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable;
  • infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person;
  • violates the legal rights (including the rights of publicity and privacy) of others or contains any material that could give rise to any civil or criminal liability under laws or regulations;
  • promotes any illegal activity, or advocates, promotes, or assists any unlawful act;
  • involves commercial activities or sales, such as contests, sweepstakes, and other sales promotions, barter, or advertising; and/or
  • gives the impression that the material emanates from or is endorsed by FaithFi or any other person or entity, if this is not the case.


8. USER CONDUCT

When using FaithFi Services you agree to the following:


  • You may never share your account username or password.
  • You may never use another users's account without permission.
  • You must provide accurate and complete information when creating an account.
  • You are solely responsible for activity that takes place on your account.
  • You must immediately report any fradualent or suspicious activity to support@faithfi.com.
  • No use for unlawful purposes. Your account may be terminated and reported to authorities.


FaithFi permits the submission of publicly visible questions and answers in the FaithFi Community. FaithFi reserves the right to delete any post, comment, link or other content that it believes, in its sole discretion, violates any of the following guidelines:


  • No profanity, harassment, or hateful conduct- including discrimination, hate speech, bullying, or targeted attacks.
  • No spam, self-promotion, or links to websites that are irrelevant, solicit products or services, or contain offensive, harmful or deceitful information.
  • No inappropriate, unethical or misleading or information.
  • No plagarism, copyright, or trademark infringements.
  • No publically identifiable information, including but not limited to, first and last name, birthdate, address, phone number, email address, Social Security number, driver's license numbers.
  • No personal financial account information, including but not limited to, login credentials, account numbers, or card numbers.
  • No information that constitutes legal, investment, or professional advice.


When you post or comment in the FaithFi Community or across any of FaithFi Services, you agree to:


  • Submit posts and comments that contribute to a high quality, substantive exchange of information and ideas.
  • Automatically grant FaithFi royalty-free, perpetual, worldwide, irrevocable, non-exclusive and fully transferable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display any submissions.


9. PAID SUBSCRIPTIONS


  • By subscribring to FaithFi subscription products ("Subscriptions"), you agree to pay the applicable Subscription fees. FaithFi reserves the right to change Subscription fees upon reasonable notice.
  • Unless stated otherwise in writing, Subscription fees are nonrefundable.
  • You may cancel your subscription at any time. Cancelled subscriptions will terminate at the end of the subscription period. For free trials, you must cancel your subscription no later than 24 hours before the trial end date to avoid being billed.
  • FaithFi reserves the right to cancel a Subscription at any time. If FaithFi cancels a Subscription due to a breach of Terms of Service you may not be elligible for a refund.

10. WARRANTY

FAITHFI, AND ANY PRODUCT OR SERVICE OBTAINED OR ACCESSED THROUGH THE SITE, IS PROVIDED "AS IS" AND WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FAITHFI MEDIA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, SUPPLIERS, SPONSORS, AGENTS, INFORMATION PROVIDERS AND ANY OTHER THIRD PARTY INVOLVED IN OR RELATED TO THE MAKING OR COMPILING OF THE SITE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE AND NON-INFRINGEMENT, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ALL WARRANTIES RELATING TO THE ORIGINALITY, ADEQUACY, ACCURACY, TIMELINESS, MERCHANTABILITY OR COMPLETENESS OF ANY INFORMATION ON OUR SITE.


FAITHFI AND ITS SPONSORS, INFORMATION PROVIDERS AND ANY OTHER THIRD PARTY INVOLVED IN OR RELATED TO THE MAKING OR COMPILING OF THE SITE DO NOT WARRANT THAT YOUR USE OF THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT THE SITE OR THE SERVER(S) ON WHICH THE SITE IS HOSTED ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE AND YOUR RELIANCE THEREON. NO OPINION, ADVICE, OR STATEMENT OF SEEKING ALPHA OR ITS AFFILIATES, SUPPLIERS, AGENTS, MEMBERS, SPONSORS, INFORMATION PROVIDERS OR VISITORS, WHETHER MADE ON THE SITE OR OTHERWISE, SHALL CREATE ANY WARRANTY.


11. LIMITATION OF LIABILITY

IN NO EVENT WILL FAITHFI, ITS LICENSORS, SERVICE PROVIDERS, OR ANY OF THEIR EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, FAITHFI, ANY WEBSITES LINKED TO IT, ANY CONTENT OFFERED ON OR THROUGH FAITHFI, OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH FAITHFI, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.


THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.


12. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless FaithFi Media, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of FaithFi including, but not limited to, your User contributions, any use of FaithFi content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from FaithFi.


13. TERMINATION

You understand and agree that FaithFi may, under certain circumstances and without prior notice to you, terminate your access to and use of Services. Cause for termination shall include, but not be limited to, (i) breaches or violations of the Terms of Service, (ii) requests by law enforcement or other government or regulatory authorities or (iii) repeat violators of third party copyrights or other intellectual property.


14. END USER LICENSE AGREEMENT

FaithFi is licensed to You (End-User) by FaithFi Media, located at 3301 Windy Ridge Pkwy SE #50, Atlanta, GA 30339, United States (hereinafter: Licensor), for use only under the terms of this License Agreement.


All rights not expressly granted to You are reserved.

16. ENTIRE AGREEMENT

These Terms and our Privacy Policy constitute the sole and entire agreement between you and FaithFi Media with respect to FaithFi and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to FaithFi.
